Whether it be multi-defendant matters where a standard ATE product doesn’t fit, or a hybrid funding solution, we work closely with IPs and our partner solicitors to create the most cost efficient product.

Our application process is the same as for a standard commercial case, including an “in-principle” decision within 3 working days of receiving a Proposal Form. We also recognise the need for maximising the possibility of dividend payments to creditors and therefore Acasta has staged discounts on the premium specifically tailored for insolvency.

ATE Premiums

All our bespoke premiums are quoted on the basis of each case going to Trial. However, we also offer significant discounts linked to the progress of the Claimants case. The discounts reflect the increased risk as the case heads to Trial. From our previous experience, our data shows that most cases settle early. Therefore, the Claimant benefits from the discounted premium.

The discounts are linked to 4 stages in the progress of a case. However, we are often asked, and are happy to offer (subject to assessment), cover at any stage of the case.

Stage 1. Any point prior to the issue of proceedings.

Stage 2. Any point after the issue of legal proceedings but prior to or on the date of the first hearing (if the first hearing is not the final hearing).

Stage 3. Any point after the date of the first hearing (if the first hearing is not the final hearing) up to 21 days before the final hearing.

Stage 4. Any point from the date 21 days before the date of the final hearing
