ATE PERSONAL INJURY INSURANCE FOR SOLICITORS

Despite the Jackson reforms abolishing recoverable premiums and bringing in Qualified One Way Costs Shifting there is still a need for ATE Personal Injury insurance for personal injury at affordable premiums because QOCS can be withdrawn and claimants still need protection from finely judged Part 36 offers.

In the post Jackson era many solicitors question the role of ATE personal injury insurance now that premiums are no longer recoverable from the Defendant but we believe that ATE is still relevant and needed. Qualified One Way Costs shifting can still be disallowed in some cases. In lost cases there are still disbursements to be settled and Defendants costs to be paid.

Claimants still need the protection that ATE personal injury insurance can offer to avoid being forced into accepting low Part 36 offers safe in the knowledge that they have the backstop of ATE should they fail to beat any offer. Post Jackson premiums have reduced and as a result we at Acasta have reviewed our offerings and have, we believe, a range of premiums for all types of injury claims that are flat rated, competitive and affordable given the limit of indemnity and cover we provide.

We have a simple online system that allows solicitors to issue policies in a matter of minutes and our reporting requirements on the progression of cases are very straightforward and only relate to key events such as the issue of proceedings, part 36 offers and settlement. We are also happy to consider facilities for practises who can demonstrate a good understanding and experience of claims for Noise Induced Hearing Loss subject to agreeing at what point our ate personal injury insurance can be utilised.

Acasta can offer:
  • ATE personal injury insurance cover for all types of personal injury claims including Road Traffic Accidents, Employers, Public and Occupiers Liability claims and Industrial Injuries including Noise Induced Hear Loss
  • Delegated authority (self issue) facility through our on-line system
  • Variable limits of indemnity
  • Competitive, flat rated premiums right through to hearings
